The present writ petition has been filed seeking directions to the respondent to approve the proposed name, i.e., "ALL INDIA DHARMAYUGAM MAKKAL KATCHI" and register the said proposed political party before the Election Commission of India ("ECI"), New Delhi, prior to expiry of the date of submission of application for allotment of common symbol for the State of Tamil Nadu.

It is submitted that the petitioner wants to setup its candidate in the forthcoming General Legislative Assembly Election of Tamil Nadu State, which is scheduled in the year 2026.

It is submitted that the ECI has issued a circular for submission of application under Para 10B of the Election Symbols (Reservation & Allotment) Order, 1968, for allotment of common symbol in the State of Tamil Nadu on 11th November, 2025. However, respondent has neither approved the proposed name nor registered the petitioner as a political party The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that a General Body Meeting was held on 22nd April, 2025, which was presided over by Mr. Krishnan Moni, wherein, it was discussed to form a new political party and to get it registered before the ECI. Thus, all the members present in the meeting had given their consent and thereafter the name "ALL INDIA DHARMAYUGAM MAKKAL KATCHI" was confirmed. Further, nine alternative names were also proposed by the members.

It is submitted that as per the guidelines of the ECI, the petitioner on 20th May, 2025, submitted the application under Section 29-A of the Representation of People Act, 1951, along with nine proposed alternative names before the ECI, to register the political party. 6.
It is submitted that an acknowledgement letter dated 26th May, 2025 was also sent by the respondent to the petitioner herein. However, the respondent had also sent a letter dated 19th August, 2025, to the petitioner to submit the documents, as per checklist Item No. 28, Item No. 29/30 and Item No. 32. The said documents, as per the directions of the respondentECI, were also submitted by the petitioner. However, till date, the respondent has not approved the name of the political party. Thus, the present writ petition has been filed.

Learned counsel for the petitioner submits that the petitioner has already fulfilled all the criteria for registration of political party, as per the guidelines of the respondent, and relevant documents with regard thereto, have also been filed.

Learned counsel for the respondent-ECI has handed over to this Court letter dated 10th December, 2025, written by the ECI to the District Election Officer, District- Kanyakumari, Tamil Nadu - 629001, which is reproduced as under:

By referring to the aforesaid letter, learned counsel for the respondent-ECI submits that the respondent is still awaiting the response from the District Election Officer. She submits that as soon as the said response is received, a 30 day public notice shall be published in the newspaper by the petitioner, by way of which, objection to the registration shall be invited. In case, any objection is received to the registration of the political party of the petitioner, the same shall be considered by the ECI. 11.
Learned counsel for the respondent-ECI further submits that pursuant to the letter issued by the ECI, the requisite documents were submitted by the petitioner only on 09th October, 2025.

She further submits that the application of the petitioner is under consideration and that some time may be granted for the same. 13.
At this stage, learned counsel for the petitioner expresses urgency and submits that the ECI may expedite the process. 14.
Considering the submissions made before this Court, since the ECI is awaiting information from the District Election Officer, the ECI is directed to communicate with the District Election Officer, District - Kanyakumari to give the requisite information, expeditiously. 15.
Further, it is directed that the ECI shall do the needful within a period of eight weeks, in accordance with law.
