The Complainant has filed a petition under Section 125 of the Code of Criminal Procedure, 19731, seeking maintenance for herself and her minor child. The proceedings were instituted in the year 2022 and it is contended that, till date, even the application for interim maintenance has not been decided. The matter is still at the stage of completion of pleadings and the written statement was filed on 25th November, 2025, after a delay of nearly three years.

It is urged that the Petitioner is a housewife with no independent source of income and is entirely dependent upon her father for sustenance. She is the legally wedded wife of the Respondent and the minor child is his daughter, whom the Respondent is legally and morally obliged to maintain. The Respondent is stated to be a man of means, employed as a Finance 1 "CrPC"

Executive with Gurukul The School, Dasna, Ghaziabad, U.P., earning approximately INR 60,000/- per month and leading a comfortable life. In contrast, it is submitted, the Petitioner and her minor daughter are facing acute hardship, as the Respondent has not paid any amount towards their maintenance and has neglected and refused to maintain them, despite having no other dependent liability. In the absence of any maintenance support from the husband, the Petitioner is unable to sustain herself and her minor child. 3.

It is noted that, as per the averments made in the petition, the underlying complaint has been listed on as many as seventeen occasions; however, the Petitioner's application seeking interim maintenance remains undecided.

Having regard to the aforesaid facts and circumstances, the present petition is disposed of with a direction to the Trial Court to decide the Petitioner's application for interim maintenance expeditiously preferably within three months from today.

With the above directions, the present petition is disposed of. 6.

Copy of the order be sent to the concerned Trial Court for necessary information and compliance.

The Court has not commented on the merits of the case. 8.
