The present petition has been filed on behalf of the petitioners under Article 226 of the Constitution of India read with Section 528 of BNSS (Section 482 Cr.P.C.) seeking quashing of FIR No. 585/2024 under Sections 420/34 IPC registered at P.S. Alipur and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Petitioners are present in Court, whereas respondent nos. 2 to 4 have joined through VC. They have been identified by Mr. Deepak K. Sharma, learned counsel for petitioners, Mr. Ayush Kr. Singh, learned counsel for respondent nos. 2 to 4, as well as, by the Investigating Officer IO/SI Raj Kumar, PS-Alipur.

The case of the prosecution is that an agreement to sell dated 03.03.2023 was entered into between the petitioners and respondent no.2 whereby the petitioners agreed to sell a property in question to respondent nos. 2 to 4 for a total sale consideration of Rs.3.14 Crores, against which an amount of Rs.53,00,000/- was paid by respondent nos. 2 to 4 towards earnest money. Thereafter a dispute arose between the parties, which led to the filing of suit by the petitioners seeking revocation of the aforesaid agreement to sell. The dispute also led to the registration of aforesaid FIR at the instance of respondent nos. 2 to 4.

During pendency of the proceedings the parties were referred to the Delhi High Court Mediation and Conciliation Centre, where they have arrived at a settlement, terms whereof were reduced in writing in the form of settlement agreement dated 22.11.2024, copy of which is annexed as Annexure-P-2 to the present petition.

In terms of the said settlement, it has been agreed by the petitioners that they shall pay full and final settlement amount of Rs. 43,00,000/- jointly to the respondent nos. 2 to 4. Substantial amount is stated to have been paid in terms of the settlement. The balance amount of Rs.23,00,000/- has been paid in the following manner:

Rs.7,00,000/- has been paid in favour of respondent no. 3 Deepali Giroh by way of demand draft bearing no. 014833 dated 12.09.2025 drawn on Axis Bank.

Rs.8,00,000/- has been paid in favour of respondent no. 4 Nakul Mittal by way of demand draft bearing no. 846922 dated 12.12.2025 drawn on Union Bank.

The aforesaid demand drafts have been handed over by learned counsel for petitioners to learned counsel for respondent nos. 2 to 4 in Court. 10.
On being queried by the Court, respondent nos. 2 to 4 affirms the factum of settlement and acknowledge having received the full and final settlement amount. They state that they do not wish to prosecute the criminal proceedings any further and have no objection in case the FIR is quashed. 11.
In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all other proceedings emanating therefrom be quashed.

Consequently, the petition is allowed and the FIR No. 585/2024 under Sections 420/34 IPC registered at P.S.
Alipur alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 15.
