CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 11.04.2018 Notice.
Learned APP accepts notice for respondent no. 1.
Respondent no. 2 Ms. Seema is present in Court along with her counsel and accepts notice. Respondent no. 2 has been identified by SI Kamal Kumar of Police Station Okhla Industrial Area.
It is submitted that petitioners and respondent no. 2 are neighbours. A quarrel took place between them on some trivial issues, which led to registration of FIR no.74/2014 under Sections 323/341/354/34 IPC at police station Okhla Industrial Area on the complaint of respondent no. 2. With the
interventions of common friends and other family members, petitioners and respondent no. 2 have settled their disputes amicably; therefore, aforesaid FIR and the consequent proceedings emanating therefrom may be quashed. Respondent no. 2 admits having settled the matter with petitioners of her own free will, voluntarily and without any undue force, pressure or coercion before the Mediation Centre, Saket Courts, New Delhi on 16th November, 2015 and she has no objection in case FIR is quashed against the petitioners. Affidavit of respondent no. 2 is also on record at pages 24-25. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, FIR no.74/2014 under Sections 323/341/354/34 IPC registered at police station Okhla Industrial Area and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
