The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the petitioner for seeking parole for a period of one month.

Status report filed; it is taken on record.

I have heard the learned counsel for the parties and have examined the file.

Nominal roll dated 08th May, 2018 reveals that the petitioner was convicted under Sections 376(2)(G)/323/34 IPC and was sentenced to under go rigorous imprisonment for ten years with fine `1,01,000/-. Criminal Appeal No.1179/2015 was dismissed by this Court on 18th October, 2016. It further reveals that the petitioner has undergone seven years, one month and ten days incarceration besides remission for eight months as on 08th May, 2018.

The petitioner is not previous convict and is not involved in any other criminal cases. Earlier, he was granted interim bail and there are no allegations on his misuse except that on one occasion he was late by two days to surrender.

The address of the petitioner has been verified and confirmed. 7.

In the interest of justice and for the reasons mentioned in the petition, the petitioner is granted three weeks parole from the date of release on his furnishing personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Trial Court. After expiry of the parole period, the petitioner shall surrender before the Superintendent Jail. 8.

The petition stands disposed of.
