% 16.03.2017 Crl. M.A. No. 4401/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

BAIL APPLN. 467/2017 & Crl. M.B. No. 470/2017 The petitioner has preferred the present anticipatory bail application to seek anticipatory bail on the ground that he contemplates arrest in a case which is not yet registered and which may be registered u/s 406/498A/34 IPC on the complaint of the petitioner's wife.

The submission of Mr. Singh is that even though the parents of the complainant reside in Patparganj, she has preferred to approach the CAW Cell, Malviya Nagar on account of their influence at the said forum.

The complainant is present in court and she states that on account of the threats received from the petitioner and his family members, she had to shift her residence to Malviya Nagar and on this account she has approached the CAW Cell, Malviya Nagar.

As on date, there is no FIR registered in the present case. Before the arrest of the petitioner, the approval of the DCP is also required to be obtained. In these circumstances, since no FIR has been registered till date, the petition is premature. The same is, accordingly, dismissed. VIPIN SANGHI, J MARCH 16, 2017 sr
