At the outset, counsel for the respondents has raised an objection with regard to the maintainability of the present petition on the ground that the departmental enquiry based on the charge-sheet dated 18.01.2018 is still pending consideration and no final decision has been taken as of now. He submits that till the enquiry is completed and a report submitted to the Disciplinary Authority, no final decision can be taken. 2.

Counsel for the petitioner concedes that the departmental enquiry based on the charge-sheet dated 18.01.2018 is pending against the petitioner and on 30.03.2018, the petitioner was granted two weeks' time to respond to the report of the Inquiry Officer. He states that his client has already submitted a reply on 23.03.2018.

This being the position, we decline to entertain the present petition, which is premature. The same is accordingly dismissed alongwith the pending application. Needless to state that if the petitioner is aggrieved by the decision taken by the competent authority, he shall be entitled to seek legal recourse, as may be available to him.
