% 08.08.2016 With the consent of the learned counsel for the parties, the writ petition is taken up for hearing.
The challenge in the writ petition is to the impugned order dated 16.04.2014 de-inducting the petitioner from the Central Athletics team and the movement order dated 12.06.2014. One of the contention urged by Mr. Ankur Chhibber, learned counsel for the petitioner, by relying upon an order passed by this Court in W.P. (C) No. 2493/2014 is that before the impugned order was passed, no show cause notice was issued to the petitioner. Mr. Amrit Pal Singh, learned counsel appearing on behalf of the respondents submits that the respondents shall issue a show cause notice
seeking a response from the petitioner on the impugned action. In view of the aforesaid submission made by the learned counsel for the respondents, impugned order dated 16.04.2014 and the movement order dated 12.06.2014 are set aside giving liberty to the respondents to issue a show cause notice to the petitioner with regard to de-inducting the petitioner from the Central Athletics team and thereupon seeking a response from the petitioner before passing a final order. This process shall be completed within a period of ten weeks from today. Needless to say the impugned order dated 18.06.2014 by which this Court has stayed the impugned order dated 16.04.2014 and the movement order dated 12.06.2014 shall continue till the passing of the final order by the respondents in terms of this order passed by this Court.
