% 24.04.2018 As per FIR, specific role has been assigned to the petitioner of giving brick blow to the victim, who remained hospitalised for 10 days. Learned counsel for the petitioner submits that co-accused has already been granted bail. Learned APP submits that co-accused has been granted regular bail after having remained in jail for 20 days.
Petitioner is seeking anticipatory bail, therefore, no parity can be claimed from the co-accused who has been granted regular bail. Keeping in mind totality of the facts and circumstances, bail application is dismissed.
Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
