Appellants seek setting aside of order dated 23.11.2017, whereby, the application of the appellants under Section 340 Cr.P.C. was rejected.

Learned counsel for the appellants seeks leave to withdraw the appeal with liberty to file an appeal in terms of Section 341 Cr.P.C. before the appropriate Court.

In view of the above, the appeal is dismissed as withdrawn with liberty to the appellants as prayed for.
