For the reasons stated in the applications, the same stands allowed. The delay of 9 days in re-filing the matter stands condoned. 2.

The application stands disposed of.

ARB.P. 148/2025 1.

The facts of the case would indicate that with respect to the same controversy, earlier an Arbitrator was appointed vide order dated 01.05.2024 in ARB. P. 210/2024. The concerned arbitrator had expressed his inability to conduct the arbitration and accordingly, the instant petition has been filed. 2.

In view of the aforesaid, the Court finds that as per Clause 15 of the Vendor Agreement for Services/ Material Supply/Works dated 23.12.2021, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the dispute is capable of being adjudicated by way of Arbitration. 3.

The respondent also does not have any objection in the appointment of an Arbitrator.

Accordingly, the Court appoints Mr. Shyam Kumar Tandon, Advocate (Mob No.-+91 9811719888, Emailshyamkumartandon@gmail.com) as an Arbitrator to adjudicate the dispute between the parties.

The remaining terms and conditions of order dated 01.05.2024 shall remain intact. The parties shall approach the learned arbitrator within two weeks from today.
