O R D E R
% 17.05.2018 The respondent, who is present in Court, states that he has been pursuing the litigation for the past about 13 years and his money has not been returned. He is agreeable to the decretal amount, along with interest accrued thereon, being paid to him in monthly installments of not less than Rs.50,000/-.
The appellant No.1 who is present in Court, through his counsel, conveys his acceptance to the said deferred/mitigated period of payment.
Accordingly, the appellant is directed to pay the decretal amount along with interest accrued thereon, in installments of Rs.50,000/- each into the respondent's account: SBI A/c No. 31821958471, NSIT Dwarka, New Delhi. The first instalment shall be paid on or before the 10th June, 2018. The remaining amounts shall be paid in instalments of Rs.50,000/- each on or before the tenth day of each month of the Gregorian Calendar. Any
infraction in payment of the amount, either by the date or by quantum shall be visited with a cost of Rs.2,000/- for such infraction, which too shall be paid into the aforesaid account.
The appellant states that he shall abide by the terms of this consent order. His undertaking is accepted. In addition, an affidavit of undertaking in terms of this order shall be filed by the appellant within one week. The appeal, alongwith pending application, stands disposed off in the above terms.
A copy of this order be given dasti to the parties under the signature of the Court Master.
