% 10.02.2016 The petitioner has filed the present petition under Section 9 of the Arbitration and Conciliation Act, 1996 for interim measures. The present petition is pending since August, 2007. I have been informed by the parties that the arbitrator has entered upon reference and the proceedings are in progress.

Both the parties agreed that the present petition be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 before the Arbitrator who may decide the same on the basis of pleadings of the present petition.

The petitioner to file the pleadings of the present petition before the Arbitral Tribunal who will decide the same as per its own merits. Learned counsel for the respondent has no objection is the interim order dated 14th December, 2012 shall continue till it is modified or

disposed of by the Learned Arbitrator.

The petition is disposed of.
