% 30.11.2016 Service report is awaited. Learned counsel for the petitioner has tendered in court the report with regard to service of the respondent/ accused. From the same, it appears that the bond under Section 437A Cr PC was not obtained by the court. The respondent also does not appear to have been deported by the FRRO. Learned counsel submits that the LOC has been issued in respect of the respondent.

Since the respondent is a Nigerian international and is not presently available, I do not consider it necessary to keep the leave petition pending. The same is, accordingly, dismissed with liberty to the petitioner to revive the same in case the whereabouts of the respondent are located.

The Trial Court is directed to preserve the original Trial Court record in the meantime.
