Petitioners (non-claimants in arbitral proceedings) have assailed order dated 28.08.2025 of the learned Sole Arbitrator, whereby one witness namely Mr. Kapil Jain sought to be summoned and examined on behalf of the present petitioners was dropped by way of detailed order. 2.

After addressing partly, learned senior counsel for petitioners, on instructions, seeks permission to withdraw this petition with liberty to raise same arguments as raised in this petition at the stage of final arguments before the learned Arbitrator where the matter is stated to be listed on 18.12.2025.

As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
