A Criminal Revision Petition under Section 438 read with Section 442 BNS has been filed on behalf of the Petitioner challenging the impugned Order dated 12.09.2025 of learned ASJ, whereby the Application under Section 311 Cr.P.C has been dismissed in SC No.266/2024 pertaining to FIR No.287/2023 Police Station Malviya Nagar under Section 354D IPC. 4.

A technical objection is taken by learned APP for the State against that the Revision Petition is not maintainable against the impugned Order which is interlocutory in nature.

After some submissions, learned counsel for the Petitioner seeks permission to withdrawn the present Revision Petition with liberty to file the appropriate Petition under the relevant Sections. 6.

The Revision Petition stands disposed of along with the pending Application(s).
