This application is filed jointly on behalf of the Plaintiffs and the Defendant under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between the parties.

This suit was instituted on behalf of the Plaintiffs against the Defendant inter alia seeking decree of permanent injunction restraining the Defendant and all others acting on his behalf from using the process as claimed in IN 466296 and/or IN 530568 and from using, offering for sale, selling, importing the products obtained directly from the processes claimed in the aforesaid patents, amounting to infringement, amongst other reliefs. 3.
During the pendency of the suit, parties have amicably settled their inter se disputes and terms of settlement are incorporated in paragraph 3 of this application. Court has perused the terms of settlement and finds the same to be lawful. Plaintiffs are held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870.
