CORAM:

HON'BLE MR. JUSTICE VALMIKI J. MEHTA

O R D E R

% 11.04.2018 1.

This appeal was argued in detail. It was found that there is no merits in the appeal because appellant no.1/defendant no.1 was a tenant in the suit property and she claimed that the landlord/owner Mr. Nirwair Singh executed a Will in favour of the appellant no.1/defendant no.1 on 16.6.2006. It is noted that Sh. Nirwair Singh had a family comprising of his wife and two sons and it is alleged that instead of giving the property to his family Sh. Nirwair Singh gave the property to the appellant no.1/defendant no.1 who was at best, even as per the case of the appellant no.1, a tenant in the suit property barely for about six years.

for the appellant, but counsel for the appellant at this stage states that the appeal be disposed of as not pressed. Ordered accordingly. VALMIKI J. MEHTA, J APRIL 11, 2018 ib
