CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 29.08.2018 Mr. Sudhi Ranjan Prasad, Authorized Representative of respondent no. 2 - Bharti Enterprises Limited is present in Court and accepts notice. He has been identified by SI Manish Yadav of police station Vasant Kunj North. Copy of board resolution dated 9th March, 2018 has been placed on record.

Authorised Representative submits that matter has been settled between the petitioner and respondent no. 2, inasmuch as terms of settlement have been complied with by repairing the damaged property. Mr.Sudhi

Ranjan Prasad says that respondent no. 2 has no objection in case FIR No. 638/2017 under Sections 279/427 IPC and Section 185 of the Motor Vehicles Act registered at Police Station Vasant Kunj North and consequent proceedings emanating therefrom are quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
