The present writ petition has been filed seeking directions to the respondents to demolish the unauthorized construction and also to remove the illegal encroachment on the 'Municipal Corporation of Delhi ('MCD') Park Near Metro Pillar No. 894A, Dwarka' (hereinafter the 'subject property'). 2.

Status report has been handed over in Court today by Mr. Kapil Dutta, Standing Counsel appearing on behalf of the respondent no.1/MCD. In the status report, it is stated as under:

i.

The subject property was inspected on 2nd December, 2025 and it was found that the residents have illegally encroached and extended the Chajjas on the Government land near Metro Pillar No.894-A. ii.

The unauthorized construction was booked on 2nd December, 2025. iii.

A work-stop notice was also issued on 8th December, 2025 to the SHO, Police Station-Sector 17, Dwarka and the demolition order was passed on 21st January, 2026.

iv.

An attempt was made to carry out demolition action on 18th March, 2026 but it could not be executed due to non-availability of Police force.

v.

Further action has been planned on 22nd April, 2026. 3.

Taking into account what is stated in the status report, the present writ petition is disposed of while directing the respondent no.1/MCD to take action as stated in the status report.

The concerned Police station shall provide adequate Police force to the respondent no.1/MCD for carrying out the proposed action on 22nd April, 2026.

In the event the petitioner has any further grievance with regard to unauthorised construction, it is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier shall remain protected.
