+ CRL.M.C. 1736/2018 MAHESH SHARMA @ MAHESH BALHARA @ MAHESH KUMAR ..... Petitioner Through :

Mr Dinesh Malik and Mr Manish Malik, Advocates.

versus STATE & ANR ..... Respondents Through :

Mr Raj Kumar Yadav, Advocate.

SI Rajiv Singh, PS Mehrauli.

CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 14.05.2018 1.

Petitioner seeks quashing of FIR No.1228/2015 under Sections 354A/354D/509/506 IPC, Police Station Mehrauli, based on a Settlement. 2.

Parties are neighbours. Subject FIR was registered consequent to a quarrel.

Cross FIR was also registered against the son of the complainant/respondent No. 2.

3.

Parties have settled their dispute before the Mediation Centre, Saket Courts, New Delhi, on 25.09.2017.

4.

Consequent to the Settlement, the offences in the cross-FIR registered against the son of respondent No.2 have already been compounded.

5.

The Settlement records that the dispute occurred on the spur of the CRL.M.C.1736/2018

moment and the parties have agreed to amicably settle their disputes with a view to restore peace and harmony between them. 6.

Parties are present in Court in person, and are identified by the Investigating Officer. They confirm that they have arrived at a Settlement with a view to maintain peace and harmony between them and further submit that they do not wish to press charges against each other. 7.

In view of the above and keeping in view of the fact that the parties have resolved their dispute with a view to restore peace and harmony between them and a Settlement has been arrived at between them before the Mediation Centre, Saket Courts, New Delhi, on 25.09.2017, consequent to which the cross-FIR filed against the son of respondent No.2 has already been compounded and the offences under the FIR has been compounded and further that they do not wish to press charges against each other, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

8.

Accordingly, FIR No.1228/2015 under Sections 354A/354D/509/506 IPC, Police Station Mehrauli, and the consequent proceedings emanating there from are hereby quashed. 9.
