Counsel appearing for the Municipal Corporation of Delhi (MCD) has raised preliminary objections that the claim sought to be canvassed in petition is stale.

The fact remains that the claim which is sought to be canvassed in the petition is based on an incident of 2021, whereas the petitioner is claiming that he was pursuing his representation with respondent. 3.

petitioner, as claim appears to be time barred. 4.

However, in case petitioner intends to carry out vending activity in accordance with the terms of Certificate of Vending, we see no reason for respondent to cause any interference in such activity. 5.

As regards the claim of petitioner for allotment of alternate site, it is open for petitioner to approach respondent, which request or representation, if so made, shall be considered in accordance with law, expeditiously. 6.

With above observation, petition stands disposed of. 7.
