This an application filed under Section 151 of CPC, 1908 seeking revival of the present writ petition.

For the reasons stated in the application, issue notice. 3.

Mr. Sumit Sharma, learned counsel accepts notice on behalf of the respondent Nos. 3 and 4 (Bank of Baroda).

The advance copy of the application has been served to respondent Nos. 1 and 2, however nobody is appearing.

In view of the urgency, the matter is being taken up for hearing. 6.

The petition was disposed of vide order dated 16.12.2025 and in paragraph No. 9, it was directed as under:

"9.

Accordingly, writ petition is disposed of directing Respondent No.4 to treat this writ petition as a representation and take a decision within three weeks from today, after looking into the averments made as also the documents appended thereto. provided the needful shall be done. However, if for any reason, the decision is otherwise, a speaking order will be passed and communicated to the Petitioner within one week from the date of the decision and Petitioner will be at liberty to take recourse to legal remedies, if so advised."

Pursuant to the said order, Bank of Baroda has passed the order on 22.01.2026 and had refused to give documents on the basis that the petitioner has not been able to give Surviving Member Certificate. 8.

Ms. Munjal, learned counsel for the petitioner states that the same is difficult as the petitioner is litigating with his other sibling. 9.

However, she states that in the present case, the deceased had 3 legal representatives, namely, the deceased's husband, son i.e. the petitioner and another son.

The other brother is not agreeable to sign the Letter of Acknowledgment of Debt but the petitioner and the deceased's husband are ready and willing to do so.

Since the petitioner is the legal representative and so is the husband of the deceased, it is directed that the petitioner and the husband of the deceased will give a Surviving Member Certificate and a Letter of Acknowledgement of Debt and on submission of the same, the respondents shall give copies of the relevant documents as ordered in the order dated 16.12.2025.
