O R D E R

The present petition has been filed under Section 528 BNSS, 2023 seeking regular bail in connection with FIR No.0188/2024 under Sections 363/368/370/34 IPC and Section 81 JJ Act, 2015 registered at Police Station Pul Prahladpur, New Delhi.

The case of the prosecution is that one minor child was kidnapped by accused Mala Verma and her daughter Neha Verma who had handed over the said child to the brother of Mala Verma namely, Sunil Mandal. Subsequently, Sunil Mandal is stated to have sold the said child to childless couple i.e. the petitioner herein and her husband Mukesh. 3.

child. Her boyfriend, who has fathered the child, ran away and is absconding.

He submits that the petitioner and her husband had taken the child in adoption and they were never aware that the child was kidnapped by Mala Verma and her daughter Neha Verma.

He further contends that the petitioner is in custody since 05.05.2024 and has no previous antecedents. She is in fact, a victim of circumstances. 6.
The fact that the antecedents of the petitioner are clean is also affirmed by Mr. Ajay Vikram Singh, learned APP, on instructions from the IO, who is present in Court.

Having regard to the period of custody, as well as clean antecedents of the petitioner and the submission that the petitioner and her husband were childless couple and they had taken the child in adoption under the bona fide belief that the child belongs to Neha Verma, who delivered the child despite being unmarried, this Court is of the view that the petitioner is entitled to regular bail.

Accordingly, the petitioner is admitted to regular bail subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/JMFC/Duty JM, further subject to the following conditions:
(a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
(b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and she shall not change the mobile number without prior intimation to the Investigating Officer concerned.

(c) Petitioner shall not temper with evidence or communicate with or come in contact with witnesses.
