By this petition petitioner seeks quashing of FIR No.611/2017 under Sections 420/408 IPC registered at PS Keshav Puram on the complaint of respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter.

Learned Additional Standing Counsel for the State on instructions submits that in the above noted FIR the petitioner is the only accused and the respondent No.2 is the only complainant/victim. She further states that though some amount due towards the complainant was entrusted to Aish Kumar, the salesman of complainant however the said amount has already been handed over of the complainant and thus he has no role to play in the W.P.(CRL) 1001/2018

FIR in question.

Respondent No.2 who is present in Court and is identified by the Investigating Officer states that he has settled the matter with the petitioner at the time of grant of bail to the petitioner before the learned Special Judge 1st February, 2018. The petitioner has since paid him all his entire dues in the sum of `5,26,165/-, he does not want to pursue the abovementioned FIR and the proceedings pursuant thereto.

Petitioner who is present in Court and is identified by the learned counsel affirms the statement of respondent No.2. 5.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.611/2017 under Sections 420/408 IPC registered at PS Keshav Puram and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
