Learned counsel for the plaintiff realizes that he will have to properly constitute the civil suit and to re-file the same. 2.

In view thereof, he seeks liberty to withdraw the instant civil suit at this stage. He also requests for adjustment of the entire court fees. 3.

In case the plaintiff wishes to file a fresh civil suit, the liberty so prayed for is granted. The suit stands dismissed as withdrawn. The plaintiff shall be entitled to set-off the entire court fees in case, he files the suit afresh. If suit is not filed within 4 months, let half of the paid Court fee be refunded to him.
