% 17.12.2025 1.

Heard the learned counsel for the parties.

2.

This Letters Patent Appeal has been filed taking exception to an interim order dated 11.11.2025 whereby the learned Single Judge while calling upon the respondents directed that they may file their counter affidavits and simultaneously passed an order providing therein that as an interim measure, the respondents in the writ petition shall make temporary allotment of space/stall at par with the stalls/space which were being previously operated by the petitioners in the writ petition prior to commencement of renovation work, in line with the dispensation afforded to the similarly situated persons. Since the appeal has been preferred against an interim order, we are not inclined to entertain this appeal.

4.

In the aforesaid circumstances, we permit the appellants to move an application seeking vacation of the interim order dated 11.11.2025 alongwith counter affidavit within a week and in case, any such application is made, the same shall be decided expeditiously by the learned Single after affording opportunity to petitioners as well.

5.

The appeal stands disposed of in the aforesaid terms. 6.
