Learned proxy counsel for the learned ASC for the State accepts notice.

Status report has been handed over which is taken on record. Aggrieved by the order dated 17th November, 2017 to the extent that while granting first spell of furlough the petitioner was imposed condition of two sureties of ₹10,000/-, petitioner filed an application before the competent authority for reduction of the surety bond, however, the said application was rejected vide communication dated 3rd January, 2018. Hence, the present petition.

A perusal of the nominal roll reveals that besides interim bail during W.P.(CRL) 1039/2018

the pendency of the trial and appeal, the petitioner was also granted parole twice by this Court once in the year 2010 and thereafter in the year 2017 when he did not misuse the concession and surrendered in time. Vide order dated 2nd August, 2017 this Court in W.P. (Crl) 1424/2017 granted parole for a period of four weeks to the petitioner on his furnishing a personal bond in the sum of ₹5,000/- with one surety bond of the like amount, subject to the satisfaction of Jail Superintendent. Even as per the nominal roll during the said period of parole there is no allegation against the petitioner and the petitioner surrendered in time. Consequently, the order dated 17th November, 2017 granting first spell of furlough to the petitioner is modified. The petitioner be now released on furlough for a period of three weeks on his furnishing a personal bond in the sum of ₹5,000/- with one surety bond of the like amount, subject to the satisfaction of Superintendent, Mandoli Jail, rest of the conditions remaining the same.

Petition is disposed of.

Copy of the order be communicated to the petitioner thorough Superintendent, Mandoli Jail.
