% 25.04.2018 Respondent no.2-Rakhi is present in Court and has been identified by W/ASI Sushma of police station Bharat Nagar. She submits that petitioners are her relatives. A quarrel took place between her and petitioners on some trivial issue which led to registration of FIR No. 228/2016 under Sections 341/354(B)/326(B)/109/34 IPC at police station Bharat Nagar, on her complaint. She further submits that she has now settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion vide Settlement Agreement dated 29th January, 2018, therefore, she has no objection in case FIR is quashed.
It is noted that husband of respondent no.2, namely, Arun Kumar is one of the accused in connected FIR No. 39/2016 under Sections
323/326(B)/354/ 354(A)/354(B)/34 IPC registered at police station Bharat Nagar, which has been quashed vide order dated 25th April, 2018 passed in Crl. M.C. 1744/2018.
Keeping in view the settlement arrived at between the petitioners and respondent no.2 voluntarily, in the interest of justice, present FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
