It is pointed out by learned counsel for both sides that in last order, due to typographical error, the next date mentioned was 20.12.2026 whereas both sides were informed the date as 20.12.2025. Accordingly, the error stands rectified.

In furtherance of last order, learned counsel for petitioner has today appeared with instructions of his client. On instructions of his client, learned counsel for petitioner seeks permission to withdraw this petition with the request that petitioner be allowed to stay in the subject premises till 28.02.2026. That request is acceded to by respondent present in person with his counsel.

As requested, the petition and the accompanying application are dismissed as withdrawn with permission to the petitioner to continue to stay in the subject premises till 28.02.2026. or before 28.02.2026 the petitioner does not vacate the subject premises, there shall be no further indulgence and the execution proceedings shall continue further.

As requested by learned counsel for respondent, it is further made clear that this order shall have no bearing on the claim of the respondent for arrears of rent and/or mesne profits for the period till 28.02.2026, for which the suit shall continue.
