Petitioners/defendants have assailed order dated 17.11.2025 of the learned commercial court, whereby their application under Order VII Rule 10 CPC was dismissed, holding that since the orders for supply of goods were placed at Delhi and the goods were dispatched from Delhi, the courts in Delhi have territorial jurisdiction to entertain the suit. 2.

Learned counsel for respondent appearing on advance intimation submits that the learned commercial court has already framed issues subsequent to the impugned order and one of the issues is related to territorial jurisdiction.
