Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') read with Section 483(1) (B) of the B.N.S.S., 2023 (erstwhile Section 482 read with Section 439(1)(B) of the Code of Criminal Procedure, 1973), has been filed on behalf of the Petitioner with the prayer that the Bail Condition No. (iii) imposed by this Court vide Order dated 27.09.2013, in Bail Appl. No. 1273/2013 in which the Petitioner was directed to surrender his passport before the learned Trial Court, be modified.

It is submitted that a similar Order has already been passed in Crl.M.C. No. 8879/2025 pertaining to co-accused, Mahesh Kumar vide Order dated 11.12.2025.

Considering the conduct of the Petitioner and that he has been facing trial since more than 12 years, condition No.3 of Paragraph 53 of Bail Order dated 27.09.2013 in BAIL APPLN. 1273/2013, is hereby modified to the extent that the Passport of the Petitioner be returned to him, but every time, when Petitioner intends to travel abroad, he shall submits is itinerary and information with the learned Trial Court, in accordance with law. 7.
