This joint application is filed on behalf of the parties under Order XXIII Rule 3 CPC for recording the settlement arrived at between the parties.

During the pendency of the suit, parties have arrived at an amicable settlement of their inter se disputes out of Court and filed the present application incorporating the terms of settlement outlined in paragraph 4 of the application.

Court has perused the terms of the settlement and finds the same to be lawful.

Accordingly, for the reasons stated in the application, the same is allowed, recording the settlement between the parties. 5.

Application stands disposed of.

This suit is instituted on behalf of the Plaintiff inter alia seeking permanent injunction restraining the Defendant and all others acting on its behalf from infringement of registered trademark, passing off, dilution, tarnishment of trademark, rendition of accounts, delivery up, damages, etc. 7.

In view of the order passed in I.A. 4755/2026 above, suit is decreed in terms of the settlement between the parties.

Registry is directed to draw up the decree sheet. 9.

Suit is disposed of along with pending application. 10.

Dates of 19.05.2026 before Court and 04.05.2026 before the learned Joint Registrar stand cancelled.

Plaintiff is held entitled to refund of 50% Court fees in accordance with the Court Fees Act, 1870.
