The parties have amicably settled all their disputes and filed joint application under Order XXIII Rule 3 of the Code of Civil Procedure signed by all the parties as well as their counsels. The terms of the settlement are recorded in the memorandum of family settlement dated 13th March, 2018 filed along with the application. Application is also supported by the affidavits of the parties.

The plaintiff, defendant No.1, defendant No.3 and attorney of defendant No.2 are present in Court and they all confirm the settlement recorded in I.A. 8821/2018.

The I.A. 8821/2018 along with memorandum of family settlement is marked as Exhibit C-1.

The settlement between the parties is recorded and the suit is disposed of in terms of the settlement between the parties. The parties shall remain bound by the settlement.

Learned counsel for the plaintiff seeks refund of 50% of the Court fee under Section 16A Court Fees Act.

Since the parties have arrived at an out of Court settlement at the initial stage, the Registry is directed to issue necessary certificate for refund of 50% Court fees to the plaintiff under Section 16A of the Court Fees Act. J.R. MIDHA, J.
