The petitioner alongwith his counsel, Mr. Hemant Malhotra, is present in Court. Similarly, respondent no.4 alongwith his counsel Mr. J.P. Sengh, senior advocate and Ms. Sufiya Aquil is present in the Court.

Mr. Malhotra has placed on record an affidavit of the petitioner; a copy of which has been furnished to the counsel for respondent no.4.

Mr. J.P. Sengh, learned senior advocate, on instructions, says that the affidavit is in order and that respondent no.4 is willing to give six (6) months time to vacate the subject property, i.e. first floor of W.P.(C) No.3413/2018 Pg.1 of 2

the property bearing no.B-7, Extension 75, Safdarjung Enclave, New Delhi -110029.

Learned counsel for the petitioner says, in line with the affidavit, that the petitioner will vacate and handover peacefully the possession of the subject property on or before 8.10.2018. 5.

Furthermore, learned counsel for the petitioner also makes a statement, once again, on the instructions of the petitioner, that prior to handing possession of the subject property, all dues towards electricity, water and other utility charges will be paid to the authority concerned and the proof of payment will be furnished to respondent no.4.

The affidavit dated 8.5.2018, which, has been filed before me today, in Court, is taken on record. The undertaking of the petitioner is accepted by the Court. The petitioner will be bound by the undertaking given to this Court. The Registry will scan and upload the affidavit.

Pending applications shall stand closed.
