The instant petition has been filed by the petitioner impugning the order dated 30th April, 2014 whereby the learned RC dismissed the application filed by the petitioner seeking leave to defend and passed the eviction order in Eviction Petition No.62/2012. 2.

Though the petitioner is not present today, learned counsel for the petitioner, on instructions submits that petitioner intends to vacate the suit property and six months time may be given to the petitioner for vacating the suit property. He further submits that during this period of six months, the petitioner shall also continue paying the rent and shall also clear the dues of electricity and water charges before the vacating the suit premises. 3.

Learned counsel for the petitioner has also placed on record the above instructions in writing under his signature.

Learned counsel for the respondent has also signed the settlement agreement (handwritten) filed by learned counsel for the petitioner today in the Court.

Learned counsel for the parties submit that in view of the settlement entered into between the parties whereby the petitioner has agreed to vacate the suit property by 30th November, 2017 and also to clear the dues of rent and electricity/water, if any, payable by that date, this revision petition may be disposed of in terms of the settlement agreement between the parties. 6.

Accordingly, the revision petition is disposed of in terms of the settlement arrived at between the parties.

Petitioner is directed to file an undertaking in terms of the settlement within the Registry within a week with advance copy to learned counsel for the respondent.

Parties shall be bound by the terms and conditions of the settlement agreement (handwritten) placed on record today in the Court. 9.

LCR be sent back alongwith copy of this order. 10.

As prayed, copy of the order be given dasti to learned counsel for the parties.
