The petitioners seeks quashing of FIR No. 24 of 2015 under Sections 323/354/506/509/34 of the IPC Police Station Seemapuri, New Delhi, based on a settlement.

The parties are neighbours. Though the subject FIR also makes allegations against the wife of petitioner no. 1. However, learned Addl. PP for the State submits that no chagesheet has been filed qua her.

Subject FIR was registered on account of an altercation which took place in the clinic of the complainant. It is contended that with the intervention of senior members of the locality and respectable persons of the neighbourhood, the parties have settled their disputes. It is also agreed between the parties, that the petitioner no. 1 shall withdraw the suit for defamation filed by the petitioner no. 1 against respondent no. 2. Petitioner No. 1 is present in Court in person. He CRL.M.C. 1755/2018

submits that has already filed an application seeking withdrawal of the suit which is listed tomorrow and he undertakes that he shall withdraw the said suit. The undertaking is accepted. 4.

Respondent no. 2 is present in person in Court today and is identified by the Investigating Officer. She submits that she has settled the disputes with the intervention of locals and respectable people of the locality. Respondent No. 2 submits that she does not wish to press criminal complaint against the petitioners any further. 5.

In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No. 24 of 2015 under Sections 323/354/506/509/34 of the IPC Police Station Seemapuri, New Delhi and the consequent proceedings emanating therefrom are accordingly quashed.
