% 11.02.2019 After some hearing, the counsel for the petitioner submits that he may be permitted to withdraw the captioned petition directed against order dated 11.01.2016 of the Metropolitan Magistrate in his complaint case (CC no.28C/15) and the order dated 10.08.2016 of the District & Sessions Judge in Crl. Rev. No.55826/2016 thereby declining directions for investigation by police under Section 156(3) Cr. PC, the petitioner seeking liberty to apply afresh before the concerned Metropolitan Magistrate for direction to the police for investigation when the matter reaches the stage of Section 202 Cr. PC.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
