+ CRL.M.C. 2406/2018 SULINDER KUMAR & ORS ..... Petitioners Through Mr. Rajesh Kumar & Mr. Jagdev Singh, Advs versus STATE & ORS ..... Respondents Through Ms. Aasha Tiwari, APP SI Shri Gopal, PS Shakarpur

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 20.08.2018 Respondent no.3 is husband of respondent no.2 and petitioners are relatives of respondent no.3.

It is submitted that respondent No.3 (husband) and respondent No.2 (wife) have resolved their differences amicably and started living together for the last more than three years after resolving their differences. Therefore, FIR No.1352/2014 under Sections 498-A/406/34 IPC registered at Police Station Shakarpur, Delhi may be quashed. Respondent No.2 is present in Court today and has been identified by SI Shri Gopal of Police Station Shakarpur. Respondent no. 2 admits having settled the matter with respondent no.3 and the petitioners of her own free will and without any undue force, pressure or coercion. She further submits that she is not willing to pursue the FIR against any of the petitioners and the same may be quashed.

Keeping in mind that husband and wife have resolved their

differences and have started living together, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.1352/2014 under Sections 498-A/406/34 IPC registered at Police Station Shakarpur, Delhi and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J AUGUST 20, 2018 sm
