Petitioner/plaintiff has assailed order dated 13.12.2025 of the learned trial court, whereby his application for permission to summon record clerk from office of Sub-Registrar was denied on the ground that the document in question can be proved only by its author.

After addressing partly, learned counsel for petitioner/plaintiff, on instructions, seeks permission to withdraw this petition with liberty to file certified copies of the said document before the trial court. 3.

As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought, making it clear that the evidentiary value of the said document shall be independently tested by the learned trial court.
