O R D E R

% 05.07.2018 The petitioner seeks parole to file an SLP against his conviction for 10 years of which he has already undergone 9 years. Filing of an appeal is an alienable right of a convict.

The Nominal Roll of the convict presented today by the counsel for the State shows that he was given a punishment in jail on 10.04.2018. This punishment, according to the learned counsel for the petitioner, could at best be apropos some minor breach of the jail rules, but the same should not come in the way of the petitioner being released on parole to exercise his statutory rights to secure his liberty. In view of the foregoing, the Court finds no impediment in allowing the present petition. The petitioner is enlarged on parole for a period of three weeks from the date of his release on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of

the Jail Superintendent, subject to the following conditions:- (1) The petitioner shall report to the SHO, Police Station-Ashok Vihar, New Delhi once a week on every Tuesday during the period of parole. (2) He shall furnish to the SHO concerned his telephone number, which shall be kept operational at all times.

(3) He shall not leave the territory of NCT of Delhi. (4) He shall surrender before the jail authorities at the expiry of the period of parole.

With the above directions the writ petition is disposed off. A copy of this order be given dasti to the learned counsel for the parties under signature of the Court Master.
