The petitioners seek quashing of FIR No.0298/2016 under Section 354/34 IPC Police Station Sector-23, Dwarka, based on a settlement. 2.

The parties are neighbours. It is contended that with the intervention of respectable members of the locality, the parties have settled their disputes. Learned counsel for the parties submit that a Memorandum of Settlement dated 04.04.2018 has been executed between the parties. 3.

Respondent no. 2 is present in person in Court today, represented by CRL.M.C. 1771/2018

her counsel and is identified by the Investigating Officer. She submits that she has settled all the disputes with the intervention of respectable members of the locality.

She further submits that she does not wish to press the criminal complaint against the petitioners any further and is agreeable to the quashing of the subject FIR.

In view of the fact that the parties have resolved their disputes and respondent No. 2 does not wish to press her complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace and harmony are restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No.0298/2016 under Section 354/34 IPC Police Station Sector-23, Dwarka and the consequent proceedings emanating therefrom are accordingly quashed. 6.
