In deference to the observations made by the Court, Mr. Sameer Rohatgi, learned counsel for the plaintiff, after making brief submissions, seeks liberty to withdraw the suit in view of the mandate of Section 12A of the Commercial Courts Act, 2015. He, at this stage, seeks liberty to file afresh, if occasion arises.

Accordingly, the suit, along with pending applications, stands dismissed as withdrawn with the aforesaid liberty. 3.

All rights and contentions are left open.

If the plaintiff files a fresh suit, let the set-off equivalent to the Court fees already paid be granted.
