By this petition, the petitioner seeks anticipatory bail in case FIR No.714/2015 under Sections 498A/406/34 IPC registered at PS New Ashok Nagar. Petitioner is the mother-in-law of the complainant. When the present petition came up before this Court on 10th April, 2018, this Court raised a query as to whether any approval has been sought and granted from the Competent Authority for arrest of the petitioner to which the learned APP fairly submitted that till date no approval has been sought nor granted. It is unfortunate that despite orders and directions of this Court in various judgments, the fact that no approval for arrest has been sought nor granted, was not brought to the notice of the Court resulting in the dismissal of the anticipatory bail application by the learned Additional Sessions Judge. status report has been handed over by the learned APP. As per the status report, the DCP concerned has issued a show cause notice for censure to the Investigating Officer i.e. W/SI Sonam. In the status report, it is reiterated that no approval of arrest for petitioner has been granted. 2.
The bail application is accordingly disposed of directing that in case the petitioner is required to be arrested after approval is sought for and granted, prior notice of 7 days before the arrest will be given to the petitioner.
