% 18.09.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably, therefore, FIR No.154/2010 under Sections 498-A/406/34 IPC registered at police station CAW Cell, Nanakpura on the complaint of respondent no. 2, and consequent proceedings emanating therefrom, may be quashed.
Respondent no. 2 is present in Court along with her counsel and has been identified by SI Gajender Singh, P.S. CAW Cell, Nanakpura. Respondent no.2 submits that the settlement has been arrived at with petitioner before the Mediation Centre, Dwarka Courts, Delhi on 4th October, 2013. Photocopy of the same is already on record. Petitioner has handed over an FDR of `1,00,000/- to the respondent no.2 in terms of the settlement dated 4th October, 2013 and respondent no.2
submits that her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent on 15th July, 2014 passed by the Family Courts, South-West District, Dwarka Courts, Delhi. She says that she has settled the matter with the petitioner of her own free will, voluntarily and without any undue force, pressure or coercion. She further submits that she is not willing to pursue the FIR any further and the same may be quashed.
Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in the interest of justice, FIR No.154/2010 under Sections 498-A/406/34 IPC registered at police station CAW Cell, Nanakpura on the complaint of respondent no. 2, and consequent proceedings emanating therefrom, are quashed.
