The Petitioner has approached this Court under Section 15 read with Section 14(1) of the Arbitration and Conciliation Act, 1996, seeking appointment of a substitute Sole Arbitrator to adjudicate the disputes between the parties.

It is stated that the Petitioner was awarded a contract bearing no. GEMC-511687702008443 dated 13.07.2023 through the Government eMarketplace (GeM) Portal by the Respondents. It is stated that disputes arose between the parties under the said Contract. It is stated that since the Respondent failed to reply to the said notices, the Petitioner approached this Court by filing ARB.P.1318/2025 and this Court vide Order dated 17.10.2025 appointed Mr. Amandeep Joshi as the Sole Arbitrator to adjudicate upon the disputes between the parties. It is stated that on 27.11.2025, the learned Arbitrator recused himself from the matter and therefore the parties have approached this Court by filing the present Petition seeking appointment of a substitute Arbitrator.

During the course of hearing, respective Counsel for the parties jointly requested that a substitute Sole Arbitrator be appointed to adjudicate the disputes between the parties.

Accordingly, Mr.
Anupam Srivastava, Sr.
Advoate (Mob.:
9811032151) is appointed as a Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act, 1996 within a week of entering on reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.
