By way of the present petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter, referred to as the 'A&C Act'), the petitioner seeks constitution of Arbitral Tribunal comprising of a Sole Arbitrator.

Learned counsel for the petitioner submits that the parties had entered into a Contract Agreement dated 28.04.2016, Condition 70 of IAFW-2249 General Conditions of Contract read with Para 6(b) of the Contract Agreement whereof stipulates resolution of disputes through arbitration. He further states that disputes having been arisen between the parties, a notice dated 20.09.2022 was issued by the petitioner to the respondents invoking arbitration.

dated 16.01.2025, the petitioner has already proposed five names from the MoD Panel of Arbitrators to be appointed as the Sole Arbitrator vide its letter dated 03.02.2025.

Learned CGSC for the respondents/UOI submits that requisite steps for the appointment of the Sole Arbitrator out of those five names, as proposed by the petitioner, will be taken immediately and preferably within a period of ten days from today.

In view of the above, the petition alongwith pending application is disposed of.
