O R D E R

% 01.05.2025 CRL.M.A. 13333/2025 1.

The present application is filed by the applicant, inter alia, praying as under :

a. Modify the order dated 17.03.2025 passed by this Hon'ble Court and allow the Applicant to be released on Personal Bond of Rs. 10,000/- in Case FIR No 31/2019 registered with P.S- Prasad Nagar; or b. Allow the Applicant to be released on Bond of Rs. 10,000/- with the Surety of his brother Sandeep Kumar of the like amount or any amount directed by this Hon'ble Court with or without surety; and/or c. Pass such other and further order(s) as it may deem fit and proper in the facts and circumstances of the case in favour of the Applicant and in the interest of justice. 2.

This Court, by order dated 17.03.2025, had admitted the applicant on bail on the applicant furnishing a personal bond for a sum of ₹50,000/- with two sureties of the like amount. Certain other conditions were also imposed.

sureties for a sum of ₹50,000/-. He submits that due to the same, the applicant is still languishing in custody. 4.

In Re : Policy Strategy for Grant of Bail : 2023 SCC OnLine SC 483, the Hon'ble Apex Court had specifically noted that if the accused is not able to furnish bail bonds and sureties within one month from the grant of bail, the concerned Court may suo moto take up the case and consider whether the conditions of bail require modification / relaxation. 5.

After being granted bail, the applicant cannot be denied the benefit of the same merely because of his inability to furnish two sureties for a sum of ₹50,000/-.

For the reasons mentioned in the application, the same is allowed to the extent that the applicant is directed to be released on bail on furnishing a personal bond for a sum of ₹50,000/- without any surety.

It is clarified that the rest of conditions, as imposed by the order dated 17.03.2025, shall remain same.

The present application is disposed of in the aforesaid terms.
