FAO(OS) 108/2015 After hearing the learned counsel for the parties, it appears that the appellant is only aggrieved by the fact that his application under Order VII Rule 11 CPC has not been disposed of as yet and the suit is proceeding. We are informed that the next date in the suit is 13.10.2015. We are disposing of this appeal by directing that the learned Single Judge shall take up the hearing of the application under Order VII Rule 11 CPC filed by the appellant being I.A. No. 20070/2014 and dispose it at an early date. We are making it clear that we have not passed any direction staying proceeding in the suit.

The appeal stands disposed of.
