It transpires that pursuant to directions passed by this Court on 19.12.2025, the National Highways Authority of India (NHAI) has passed an order.

Mr. Tushar Mehta, learned SG, however, submits that the said order will have to be revisited by NHAI. He, therefore, has advised the NHAI to pass an appropriate reasoned order. Under these circumstances, on passing of the fresh order, if the petitioner has any grievance, the same will have to be assailed in appropriate proceedings.

In view thereof, there is no reason to keep this petition pending and instead, the Court deems it appropriate to dispose of the same with the following directions:
(i) Let the NHAI to pass an appropriate order pursuant to the observations made by this Court on 19.12.2025. Till the fresh order is passed, the interim order passed by this Court shall remain in force. (ii) If the order is against the petitioner, the same shall not be given effect to for a period of seven working days therefrom. (iii) All rights and contentions for both the parties are left open.
